General Terms and Conditions of Prague Spring o.p.s. for on-line ticket sales (hereinafter referred to as “GTC”)

Article no. 1
INTRODUCTORY PROVISIONS

1. The contract is between Pražské jaro, o.p.s. and the customer (natural or legal person). Clearing services are provided by ENIGOO s.r.o., Hlaváčova 207, 530 02 Pardubice. The organiser of the event is responsible for the execution and fulfilment of the offered event. The purchase of a ticket creates a contractual relationship directly between the customer who purchases the ticket and Pražské jaro, o.p.s.

2. These terms and conditions govern the sale of tickets for cultural or other events organised by Pražské jaro, o.p.s. and all contractual relations with customers arising therefrom.

3. The organiser of the event is responsible for the execution and fulfillment of the offered event. The purchase of a ticket creates a contractual relationship directly between the customer who purchases the ticket and Pražské jaro o.p.s.

4. Method of ticket sales
A ticket order is created by the customer by correctly entering and sending all the data necessary for the purchase of a ticket on the ENIGOO web interface, according to the procedure described in Article II of these GTC. The operator of the ENIGOO service is ENIGOO s.r.o., Hlaváčova 207, 530 02 Pardubice, email: info@deepvision.cz, Tel: +420 461 100 936, http://www.enigoo.cz. The paid ticket price is non-refundable, unless explicitly stated otherwise in these terms and conditions. The purchased ticket is not exchangeable. The organiser reserves the right to change the date of the event or cancel it.

5. The ticket price includes the statutory rate of value added tax.

6. Terms used
Organiser – a legal entity providing the organisation of cultural or other events, which closes a contract for the sale of tickets with the customer, i.e. Pražské jaro, o.p.s. The organiser is also the operator of the ENIGOO internet ordering system.
Events – cultural and all other events (exhibitions, conferences, training, fairs, etc.).
Ticket – a document entitling a natural person to enter a specific event, intended for one-time use. The customer can receive graphically different types of tickets through different sales channels.
ENIGOO Web Interface – A system that ensures the execution and payment of orders for specific events organized by the organiser. This interface is accessible from the official website of Prague Spring o.p.s. https://festival.cz/ or from third party websites.

Article II.
TICKET SALES VIA THE ENIGOO WEB INTERFACE

1. Service description
a) For the purposes of this part of the Terms and Conditions, the service means the sale of tickets for cultural or other events via the ENIGOO web interface.
b) The provision of the service can be ordered on the ENIGOO web interface. For this purpose, it is necessary to correctly enter and submit all the data required for booking tickets (First name, last name, email, phone) and then make a cashless payment online.
c) A maximum of 10 tickets in different price categories and for different events can be ordered and purchased through the service per booking.

2. Contract conclusion procedure
a) The Customer launches the ENIGOO interface from the official website of Pražské jaro o.p.s. or from third-party websites.
b) The customer selects whether he/she is interested in purchasing a ticket for an event organized by the organiser.
c) The customer selects specific available seats. Available seats are represented by the displayed active field. The selection of a seat is made by clicking in the field. The selected tickets are represented as highlighted fields. The customer has the possibility to choose from more than one event and more sectors and seats for a ticket.) The organiser reserves the right to sell a maximum of six tickets per event to one natural or legal person.
d) The basket (price) field shows the current total amount of the selected tickets. After the above ticket selection, the customer presses the order button.
e) The customer fills in the required data truthfully: first name, last name, email, telephone (hereinafter also referred to as “personal data”). In the event of false information, the Organiser reserves the right not to accept the customer’s order or to withdraw from the contract by sending a statement to the customer’s email address.
f) After filling in the details, the customer presses the pay button and is then transferred to the list of payment methods.
g) Through the GoPay payment system, the customer completes the payment. By completing the payment, the contract is concluded.
h) Once the payment is completed, the customer receives a ticket for the booked event to the email provided during registration.
i) In the event of any problem during the ticket order process that prevents the process from being completed, the customer may contact info@enigoo.cz.
j) By ordering a ticket, the customer agrees to the wording of these terms and conditions and agrees to be bound by them in the event of a contract.

3. Information for the customer – consumer
a) A consumer is any person who, outside the scope of his business activity or outside the scope of his independent exercise of his profession, concludes a contract with an entrepreneur or otherwise deals with him.
b) The customer is obliged to pay the price of the ticket when ordering it. The cost of the means of communication with the organiser (i.e. internet services) shall be governed by the price of the services that the customer uses for this purpose with the service provider of his choice.
c) The customer is obliged to inform himself of the date of the event to which the ticket relates. The customer expressly agrees to provide the services of the organiser on the date of the event.
d) The contract concluded pursuant to Article II, paragraph 2 binds the parties until the end of the event to which the ticket relates, unless otherwise provided for in these GTC.
e) The Customer acknowledges that, in accordance with Section 1837 (j) of the Civil Code, he/she is not entitled to withdraw from the contract concluded under Article II (2)
f) Any disputes between the customer and the organiser that are not resolved amicably shall be submitted to the general court in the Czech Republic

4. Registration
The Customer is obliged to check the accuracy and completeness of the data filled in section 2.e)

5. Redeeming the ticket
a) The customer shall print out the ticket obtained through the ENIGOO system and use it when entering the event.
b) Ticket verification takes place at the entrance to the event. In case of problems with reading the purchased ticket, the customer shall contact the staff at the ticket office.

INFORMATION ON DATA PROTECTION

1. Personal data
1.1 Personal data means information about the customer on the basis of which he can be directly or indirectly identified.
1.2 Name, surname, address, e-mail address are the information necessary for the purpose of managing the ticket sales records. This data will be processed by the Administrator for a period of 2 years.
1.3 You give your express consent to the above processing. Consent can be withdrawn at any time, for example by sending an email to https://festival.cz/ or a letter to the contact details of Pražské jaro o.p.s.
1.4 Please note that under the applicable legislation you have the right to:
1.4.1. withdraw your consent at any time,
1.4.2. to ask us to tell you what personal data we process about you,
1.4.3. to request an explanation from us regarding the processing of your personal data,
1.4.4. request access to and have your data updated or corrected by us,
1.4.5. request that we erase this personal data,
1.4.6. to contact us or the Data Protection Authority in case of doubt about compliance with the obligations related to the processing of personal data.
1.5 The organiser collects and processes the personal data provided by the customer via electronic media in a secure data storage.

Article IV.
FINAL PROVISIONS

1. Responsibility of the organiser
The organiser is not liable for the accuracy, completeness or timeliness of the information offered in the online offer of events on the ENIGOO web interface except with intent or gross negligence. If the organiser has information about cancelled or changed dates of events, the organiser will inform customers immediately by publishing this information on the web portal https://festival.cz/.

2. Venue conditions
2.1 The Customer is obliged to familiarise themselves with the operating regulations of the venue for which they have purchased a ticket, to observe them and to respect the instructions of the organiser relating to the event and to comply with them. The Customer acknowledges that it is not within the Provider’s capability to ensure 100 % visibility throughout the event. The quality of the view depends on the specific venue.

3.Effectiveness of the Terms and Conditions
3.1 Should any provision of these Terms and Conditions become invalid, the validity of the remaining provisions shall remain unaffected.
3.2 The Terms and Conditions shall come into force and effect on 19 May 2021.
